The positive obligations of the state under the European Convention of Human Rights

In addition to the traditional/liberal negative obligation that requires the state to abstain from interfering with human rights, the European Convention of Human Rights means states are also under a positive obligation to protect individuals from acts of interference from private parties. Drawing from existing legal principles of the case law of the European Court of Human Rights the book puts forward an original proposal for the study of positive obligations. It explains and critically analyses the state¿s positive obligations, as imposed by the European Court of Human Rights, and sets out original proposals for their future development.
